  1. Absolutely.

It's our job to protect the victim and witnesses, not the suspect.

Here's an idea. Don't commit felonies and these matters won't be of any concern.

  2. Yes, it is common to contact the victim any time a charged person is released from jail. The arrest is public record, and telling the victim is simply updating them on the case.

When I take someone to our county jail, I complete a booking slip. There is a box for victim information, and a question that states "Would victim like to be contacted when the person is released?"

  3. If he was in jail then he is going to be charged no matter what.....who they tell makes no difference and yes they can call someone and let them know that the person who has committed a crime against them is being charged.

  4. I am one of the people in my jail that releases inmates.  I am REQUIRED to notify the victim of the person being released that the inmate is leaving custody.  When it comes to information on inmates there is certain info that we can give out, such as name, DOB, charge, bail, place of arrest, etc.

  5. Not anything but since she made the statement in the first place they may feel that she has a right to be kept informed. I'm sure that they would have taken legal advice before doing anything which might prejudice any pending case and it will be up to a court to decide if they did prejudice a fair judgement. This may differ from jurisdiction to jurisdiction and depend on the charges.

  6. They are not only allowed to, they are obligated to. Since she made a statement against him, they notify her that he is out of jail for her own protection. They do this just in case he retaliates against her for making the statement against him.

  7. It continually amazes me how many people are so concerned about the rights of criminals while victims are left with the after effects of crime and given short shrift in our society.  Not only are the police well within their rights to give her the information, they are morally obligated to keep her informed of the status of the case.
