Are "Equal Rights" the same as "Legislating from the Bench?"?

When a judge decides the law reads in a way that actually is for the person, why are they "activists?"

  1. Yes, and it is so obvious to some.

  2. Because that Judge is putting his own 2 cents in when legislating.  That is not suppose to be how the law works.

Not sure what you are trying to ask, but the constitution demands "equal protection under the law."  In addition, both the federal congress and the various state legislatures have passed all sorts of laws concerning equality.  A judge who merely uses standard tools to apply those laws is simply doing his duty.  A judge who creates law where none existed is called an activist.
