Are random check points a violation of the fourth ammendment?

When we allow cops to stop us and seize our liscence and then force us to prove our innocence for no reason against the fourth ammendment? Is this a silly waist of time for our tax dollars?

  1. You signed away your rights when you accepted a Drivers License. Random stops are heavily advertised on and in the media. It is considered for "the greater good".

    Driving is a privilege, not a right ,and can be taken away, when its shown that you were breaking the law.

    Its not proving your innocence btw. No one is claiming your guilty of Drunk driving.

  5. They can be.  The supreme court has recognized that and there are very strict limits.  The check point cops will not seize a license unless they have probable cause to believe a crime has been committed.  The burden of proof applies at trial, not to the decision to make an arrest.

  8. Yes.  It is the very thing the 4th amendment was written to prevent.  Alas, our Repubic Supreme Court has deemed it legal.  They also said it was legal to own other people at one time.  

  9. No, holding a valid drivers license and operating a motor vehicle on public land allows for reasonable search.  A drivers license is rarely suspended without valid reason.

    Check points are not. (Michigan State Police v. Stitz)

  11. it states that unreasonable search and seizure is not allowed. I guess its all in how you define unreasonable. just because we are inconvenienced doesn't make it unreasonable either.

  13. Random check points do not fall under the Constitution because there is no Constitutional right to drive a car and that's why you need a license. As long as their not stopping you for an illegal search, your way out of bounds.
