Question:

Are robins protected in the state of Kansas?

We have a tree next to our house that's going to be torn down soon (much to my dismay). There's a robin nesting in one of the forks of the tree, and my mother, her boyfriend and I are concerned about the mother and babies' welfare. Also, robins are a type of songbird, if that makes any difference.

  1. why can't they wait until it's past nesting season? hug that tree and don't let them pass, hold up a picture of baby birds and a mother, the more birds the better for the natural pesticide eating habits

  3. Are you asking if Robins can prohibit someone from taking down a dying, diseased, or dangerous tree?    Would you prefer to save the Robins nest, and have a human being killed or injured by the tree?

  4. who cares? they're just robins.  why don't you take the time to care about dying kids in Africa?

Yes...ALL native wild birds are protected by the Migratory Bird Treaty Act.  Destroying this nest is punishable by fine or imprisonment.  Whoever is doing the cutting is breaking the law..you should let them know that you will report them to your local US Fish and Wildlife Service (they enforce this law).  They should wait until the birds leave the nest which does not take long.  These types of projects are SUPPOSSED to have a biologist on site to specifically check for things such as nests..like I said, someone is NOT following the correct procedures.

  6. States don't protect things. It would be on the national endangered species list and robins definitely aren't.  If you can, try to move to nest to another tree/perch/etc., but it's not likely to work.
