  2. Littering is usually a local misdemeanor.  it is not a federal crime.  Even if you take it to the extreme, littering on national grounds, it would still be a misdemeanor and not involve the constitution.

  3. Only one crime is formally defined in the Constitution, and that's treason. ("aid and comfort to the enemy.")

    The Constitution does give the States and the Congress the power to define other crimes, but no others are stated specifically in the document.

  4. Anything that is not explicitly stated in the constitution, according to said document, falls to the states to decide. That includes littering, trespassing, and having little troll collections. (just kidding)
