Are teachers at school allowed to take phones of students with out students permission on consent?

Teachers can take anything away from a student if

a.  it is distracting the education environment

b.it is illegal

c.  it is stated in the student handbook.

Most student handbooks state that phones are not permitted to be out during the school day.  If a phone is visible a teacher can take it, but the school does have guidelines as to how the student or parent can get the phone (or other object) back.

THat being said, a student should not have a use for the phone except before or after school.  If there is a real emergency, parents can contact you through the school office.  The point of you being at school is to learn not to socialize on the phone.

Yes, they are not allowed at school. I have taken all kinds of items: phones, video games, Pokemon cards...In the student handbook it lists items that are not allowed at school and then says teacher discretion to cover the ones that aren't listed. My rule is that the parent must come in to get the item. I have a locked drawer where I keep these items until a parent comes in. I had a DS up until the last day of school when the student in question finally panicked enough to tell his mom so that she could come in to get it. The mom was not mad at all at me because she knew my policy.

no.but why take your phone to school?you are there to learn and not become part of this ignorant society that you belong to,a bit of respect for your peers will go a long way.in my company you are not even allowed to have/use your mobile whilst in work.except your break time then the phone is off.in emergencies you contact the firms number.

Yes.  Most school policies allow the students to have cell phones to use in case of emergency or after school.  However, due to the pervasiveness of cell phones being used to cheat and as a device to avoid paying attention in class, they are not allowed out except after school.  If seen, it can be taken with the provision that your parent may come get it back.
