  1. There are no visas left for the 2009 Fiscal Year.  They have all been allocated, and those who received them will be able to enter the US in October 2008.  No applications will be accepted from employers until April 2009 for the 2010 Fiscal Year.

You should note that unemployment in the US has risen sharply this year.  Many companies are not renewing employment visas or are terminating those employees outright.  In either case, the employee must return home.  There are Indian companies ("body shops") who have brought people in on employment visas, but they remain benched; they have never worked and never been paid since their arrival last year on the current fiscal year's quota.

Since unemployment is rising and so many American citizens are looking for work, it is increasingly difficult for companies to prove that there are no Americans qualified for these positions.  Therefore, many more applications are being denied.  You are not likely to find an employer willing and able to apply for a visa for you, and if an employer does file an application, chances of it being approved and getting a visa are poor.

  2. I believe all the H1-B visas are taken - over 70% go to Indian companies so I would suggest checking their want ads.
