My neighbor had a Directv installed and the installer told my tree had to be cut down so they could get a signal. I told them trim it by do not cut it down. I got back from work and the tree had been cut down. Any recourse?

  1. Yeah, you can sue, and it won't be hard to win and recover. The value of a tree can be huge, if the best way to measure is to find what it would cost to have a tree precisely the same size planted.  I suspect just the equipment to do it would cost $5,000 for a day, since we're talking a tree big enough to block a satellite dish in a neighbor's yard.

But let's not get carried away about what you're dealing with.

I don't expect the company has any such policy.  I think that the installer acted pretty much on his own, and it isn't likely he was told to do anything like this by the company.

The company is still responsible, as he was their employee or agent, but it isn't like the company ordered him to do it.

Sue and settle, it's not like you found a mouse in your soft drink or they wouldn't put a two dollar part on a pinto to keep it from exploding or served coffee 40 degrees hotter than anyone else on the planet.

  2. I'd sue the socks off of them.. they'll claim you said go for it, but, you can straighten them out.. they had no right to completely remove the tree.. the dish should have been moved so there'd be no problem..

  3. uh...sue for trespass and damages.

That's insane. Problem is unless some one SAW who did it......

You don't know if it was the neighbor or the installer.
