  5. Uh, do you mean aspirin, coffee, prescription meds, or are we talking illegal substances?

    Assuming you mean illegal drugs, there are laws against taking  or having them at all (hence, "illegal").

    IF the drugs also lead to neglect or abuse of the baby, then that's a second issue.

Absolutely.  If the mother has drugs in the house, or has drugs around the baby (takes him to the crack dealer's house, etc.) that is considered child endangerment and the child can be taken away by child protective services.  If she is high around the baby it is the same.  If she is doing drugs at a party and the baby is taken care of all night and she doesn't pick him up until the morning when she's sober, the courts tend to see this more like if she was out drinking (although it doesn't look good by any means) and are more lenient generally, unless it's a habitual thing.
