It's a fruit, but it has nothing to do with growing on a tree vs. growing in the ground.  

More precisely, fruits are the product of a pollinated flower.  When a flower is pollinated, it begins to produce a fruit, which encases the seeds, which allow the plant to reproduce.

Apples, oranges, tomatoes, squash, eggplant, peppers...all fruit.

Vegetables are generally the non-fruit portion of any plant that is consumed as food.  

The only gray area is the flowers of a plant.  Some consider it a third category.  Examples of flowers include broccoli and cauliflower.
