Question:

Arrested for dui, no cause though to pull me over. Is this illegal? I didnt speed or hurt anyone.?

Easy to call someone an idiot when hiding in the vast realm of "the internet".

I did not speed (the ticket shows 35 as the speed), I did not hit anyone, I did not weave or drive recklessly, I did not drive too slow, I did not break any traffic law.

I had a flat tire and did not have a jack in the car--I had to drive to my home. I parked perfectly, but was "tipsy".

As far as I know-it isn't against the law to drive with a flat tire--it was such a short distance--that my rim is still in perfect condition.

I do have insurance, and current tabs/tags. I do have a valid license.

I think that because most police officers are running on adrenaline-that they thought I too drunk to know that I had a flat tire.

8 police cars showed up and discussed for over an hour on what to do?

This was a great waste of taxpayers money and resources.

Did I mention I live in the South and racism is rampant?

I did not have any weapons or drugs, and only 17cents in my pocket.

  1. If you were arrested he thought he had cause. You were arrested so he did have caused. So now you need to get a lawyer. The deuce is going to go on your record your insurance is going to go up. You think you can go drinking and not get stopped I really hope they throw the book at you with some jail time..


  2. Well, driving drunk is dumb, and I'm sure you've heard that, but the proper punishment should be ostracism, not jail, or stealing money from you. Technically, in the courts own terms, there has to be an injured party (corpus dilecti (sp*?) for them to arrest you. No harm, no foul. Just don't do it again!

  4. Your question is very poorly written and provides virtually no information upon which to base an answer.

    If you were stopped by the police without at least reasonable suspicion, then the stop was illegal.

    However, I cannot imagine how you would know the police stopped you without reasonable suspicion.  Unless you have either read the arrest report or spoken with the officer, there is no way for you to know what the officer based the stop on.  Just because you don't think there was a legal reason to stop you does not mean there was not.

    The elements of DUI do not include speeding or hurting someone.  You can be convicted of DUI even if you don't speed or hurt anyone.

    What you want is someone to write:"Poor Baby. . . the police are picking on you. . . .It isn't your fault...."  

    The truth is that you seem to be a classic alcoholic that refuses to take responsibility for his actions.  Why don't you try AA?  They've seen it all and heard it all and they can help you.  You're not the first case.......Your life could improve dramatically and you're human relationships also.  And, there is a slight possibility that if you told the judge you were really grateful to the policeman for giving you a reality check, making you smell the coffee, and that you're now attending AA meetings, things might go better than to be expected for you.  

    Would you like to hear about my son-in-law, an emergency room surgeon, who lost his right arm because of a guy driving a motorcycle high on coke at 8 in the morning?  Is that what you're waiting for?

    I'm only glad the cops saw you weaving all over the road in time before you crossed the center line and killed someone. I've lost dear friends of mine to morons just like you who 'didn't hurt anyone' with their drinking right up to the point that they plowed into another car and ruined someone else's life.

    I have zero sympathy for you. You deserve everything you get -- suck it up.

  7. Your actions probably got you in trouble. Something like driving slow will cause an officer to pull you over. I guess you wanted him to wait until you killed somebody to arrest you?

  8. If you are pulled over it is better to deny deny deny...refuse to take any breathalyzer or blood tests ( even if it means losing your license for a while.) ..Get a good lawyer and fight any charges they may throw at you and you will probably win.  



  9. You may have been swerving, failed to use a turn signal, had a light out, etc...  That was just cause to pull you over.

    You should've been advised why you were pulled over.  But if you were drinking and DUI, it wouldn't be very smart to nit pick.

    All the officer needs to say is you crossed over the center line, didn't male a complete stop or whatever...

    OR maybe someone saw you driving suspicious and called you in or knew you were drinking??    Then they'd have cause to pull you over -to investigatete a complaint.

Let me tell you a story - in 1975 I was driving to a rodeo arena to pick up my two children and had two teenagers in my truck with me. We were hit headon by a drunk who was driving on the wrong side of the road, with HIS two small children in his car. One of my passengers received cuts and bruises, the other had a broken jaw and numerous other injuries. I received numerous broken bones and a shattered pelvis. I had to learn to walk again and 33 years later am still paying for those broken bones and damaged nerves. I wish the law would throw the book at ALL drunk drivers everywhere.

  12. Drinking and driving is illegal, regardless of whether or not you were speeding or hurt anyone. So the charge will stand.

    An officer doesn't have to have a reason to pull you over.
