Arrested in a consulate for a drug felony?

Hello, I have a friend that left the country on probation and now he wants to come back. If he goes into a consulate to request a passport would he be arrested. The warrant is for a possession of drugs 11377(a) HS possession of a controlled substance?? any advice?

  1. Yes, he would.  

    The only 2 choices are to stay out of the country or face the consequences.  It's not the answer you were looking for but it seems to be the only options.


  2. If he is simply on probation, and does not have any outstanding warrants, then my best guess (and not legal advice!) would be to wait until his probation ends before returning to the country.

    I'm curious as to how he was able to leave the country without a passport, if one is required for his return.  

    Most likely, the charge would not show up in the passport registry, since placing him on a watch list would require an overt act on the part of the court or the prosecutor.  

    However, your post is confusing in that you mention first that he is on probation, and second that an outstanding warrant exists.  Probation is a minor issue, but a warrant could be a real problem.

    If he has a warrant, he should contact his (or a) criminal attorney for assistance with the matter.  Wish him luck!
