  1. No, of course not.  If you go up to Canada and get married she's going to need a K-3 spouse visa to come back to the USA and live with you.  That will take anywhere from 6 months to a year, after you are married, to get.

She can't just come down here and get married either.  That would take a K-1 fiancee visa.  Again, plan on 6 months to a year.

  2. Of course not.  She will have to remain in Canada while you return to the US and file for a spousal visa.  You have to prove the validity of the relationship, and you have to prove you have sufficient income and assets to support her and guarantee a $30,000 bond.  She can only enter after she is approved for the visa, and that can take up to a couple of years for the investigation, interviews, etc.

If you want to marry, it is better to apply for a fiancee visa, prove the validity of the relationship, and your ability to support.  If approved, she can enter the US and you have 90 days to marry and file for the spousal visa.  But she will probably be allowed to stay in the US while the spousal visa is processed.

  3. No.

  4. Nope! You still have to go through all the hoops of obtaining an immigrant visa.

  5. You can't bring her back to stay without a valid K-3 visa (if you are married) or a K-1(before you are married.)
