Ok i took a bank card got caught. The investigation is in the city's hands(Miami). I was un able to use the card. I understand i took the card but the punishment for taking the card and not being able to use it can not be the same as for me taking the card and ringing it up for $5,000. It has been shown that i tried to use it unsuccessfully at a gas station. what are the consequnces. you do not get the same punishment for attemted murder as you do for murder.another thing i called the police dept. to find out what the deal is gave them all my info and they dont have anything. coulndt get a case number or anything so whats the deal? i messed up. well thats it thanx

  1. Check your state's laws - they are probably very specific.

    If you stole and used the card, you'd probably face additional charges.  The punishment won't be the same, but if they showed that you tried to use it, you'd face attempt, which is a lesser-included offense.  They are probably both felonies meaning that a conviction will cause you serious and permanent civil disabilities, and the require a mandatory minimum state prison sentence if you're convicted again.

    Yeah, it's like the difference between 25 years and 25-to-life.  There is a point where different really isn't different enough.
