I recenty went thru a bad breakup, and began looking for an apt. I signed a lease and am supposed to be moving in on Thurs. However, over this past weekend Ive been given the opportunity to keep my family together....which is very important to me for my kids. Also, last week I found out that all the employees at my job who do not receive health insurance will have their hours drastically cut back....therefore making me question my ability to afford this place. Is it going to be possible for me to back out of the lease?? I know they will probably keep my deposit, but will they force me to move in??

  1. Rental contracts do NOT have rescission periods...so there is no "back out" right, unless it's outlined in the lease.

Your rental lease is a legally binding contract.  You will be responsible for its terms.  The can't force you to move in, but they can force you to pay rent as long as the unit remains empty.

  2. In the car business you have 3 days to change your mind and back out of a contract. In your case I would one either talk with a attorney who knows the contract laws in your state. They may not even charge you. If you do it wont be as much as you getting stuck in a years lease. There should be a grace period for you to back out. If you pass thatgrace period you may be stuck.
