If you're a minor, how long do you have to sue a hospital for mal-practice. Is it like other things.. do you have until you're 18?

  1. You have until  one year after you turn 18.


  2. It doesn't matter how old you are, if you can ascertain an attorney, you could even sue your parents. Your parents may not think that is such a big deal, but it must be for you to ask. get them involved with your concerns and try to settle this issue.

No.  It varies greatly from state to state.  It's often somewhere between 1 and 4 years from when the malpractice happened or when it was known or should have been known.  Some states do allow the statute of limitations to be "tolled" or paused until the minor reaches a certain age (again this age depends on the state).  Other states do not.

    However, you don't have to wait until you reach adulthood.  Usually parents or guardians bring the lawsuit on behalf of the child.

    The answer is that any minor cannot file a lawsuit, at all. The parents have to do so.
