Attorney fee's question?

What's the best argument AGAINST awarding attorney fees?

1. Me (pro per, pro se) Basically, representing myself.

2. Other party has attorney.

3. Divorce that is three years running.

4. Me - never once asked for a continuance.

5. Other party - has asked for and was granted six continuances, failed to appear twice, attorney failed to appear once.

6. Me - Never did anything to stall or delay the proceeding. Moreover, I filed the at issue, I filed to divide my pension, I offered settlement agreements, I have never missed a hearing.

7. Other party - never filed anything to move their case along.

Basically, this case should have been over 30 months ago as I was not fighting anything that they wanted. I have agreed to numerous stipulations at their request. However, they never filed or asked for anything until I demanded a trial so this can be put to rest.

So I need some info on how to proceed in denying attorney fees to the other party. My thinking is "they never moved their litigation along" and that the burden is on them and not me as I am the respondent in this matter. Therefore, their attorney fees are a direct result of stalling the litigation.

Is that my best route?
