Question:

Aus citizenship help please!!?

I'm legally a US citizen and so is my dad. My mum is a Canadian living in Aus with a permanent residency visa, married to Aus citizen. I have a permanent residency visa as well, but it will become void once I turn eighteen. Currently, I'm living with my dad in the US. My question is once my mum is legally an Aus citizen, even though I may be eighteen at that point, can I use that to get citizenship? Or does she have to get it while I'm still a minor (that's a possibility, though it's unlikely)? Or will this not work at all and I have to go through the process of getting a permanent residency visa again once I'm eighteen in Aus and THEN moving on to citizenship? Sorry for being so confusing, it's just complicated. I've checked out the Australian governments site, and it doesn't really answer these specific questions, so if anyone has any websites that DO or they personally know the answers, please help me out!

Thanks!

  1. Firstly, a visa (resident, tourist or other) is only a document that grants you entry into a country.

To become an Australian citizen, you need to be a permanent resident of Australia.

As a resident US citizen, you are not eligible to obtain Australian citizenship.  You need to move to Australia; then once you qualify, you can apply for citizenship.

  2. There may be a couple of ways round this, if your Mum is getting Oz citizenship and is married to an Oz citizen, you may be able to get a child visa (offshore 101) as long as you are under 25. This visa is a permanent visa that allows a child to travel to and remain in Australia, with their parent who is also their sponsor. The parent must be an Australian citizen, permanent resident or an eligible New Zealand citizen.

The parent acts as a sponsor for the child and can lodge the visa application on behalf of the child.

    Who is this visa for?

This visa is for a child under 25 years of age who wants to migrate to Australia.

How much will this visa cost?

What does the visa let the visa holder do?

This visa allows the visa holder to:

    live permanently in Australia

travel to and from Australia for five (5) years from the date the visa is granted.

Go to  www.immi.gov.au visas and immigration, family visas and follow the prompts. You  could apply via the Australian consulate in the US. Or you maybe able to claim citizenship by descent, this can also be done outside of Australia, but you will need to ensure in either case that you have all the documentation you will  need. It is possible to have dual nationality these days. Hope this helps
