I hold a Student Visa in Australia and i'm allowed to work 20 hours per week.

But i want to know if i can create a business or the only way is at least holding a resident visa?

I wonder about this, because in USA you can incorporate even if you don't live there.

  1. Anybody can start any type of business anywhere as long as it abides by the governing laws.

Your visa states that you can only work 20hrs per week as an "employee" of an organisation, when operating a business there may be restrictions due to you not being a citizen.

Contact the Australian Taxation Office Business tax enquiries – Phone: 13 28 66, and the Australian Business Register - Phone: 13 28 66.

At the very least you will need an ABN - Australian Business Number.

Hope i've helped, best of luck to you.

  2. student visa requirments doesnt say u cant. as long as u can justify that you dont spend more than 20 hrs on your business because after all your main purpose of being here is to study not to make money thats the arguement that counts.

on the business name and abn side of things you can register that - it doesnt matter whether u're student visa or citizen
