Australian citizenship?

i am a PR visa holder living in australia for the past 4 months. I'm 2 months pregnant now. if i deliver in australia, would my child be an australian citizen by birth?

  1. i think it depends where you are from.. i had a friend from south africa who has lived here for 2 years .. she got pregnant to her australian boyfriend and they told her she either had to have an abortion or be deported back. talk to the visa people because i dont think you will be allowed. but if they were born here yes would be an australian citizen.

    I think that the Australian government toughened up on single parents getting pregnant to Australian citizens and then trying to stay and become Australian citizens. This was because during the 1960's through to the 1990's some people came here from OS and got pregnant, married for convenience got a child, not necessarily in that order. They didn't always live together. After a couple of years they would divorce when the incoming party had Australian citizenship. The incoming party gave the Australian party money in some cases - in other cases not. I'm not suggesting that this is your motive. Just explaining how the laws got to be the way they are now.

    The government decided that it was a racket and had to be stopped. So now you can not just become an Australian citizen and I believe nor can your child. You child most likely won't be an Australian citizen - depending on whether his father will come forward and support you - or unless you can find other means to justify your staying.

    I am surprised that the department of immigration would tell someone to have an abortion in order to stay. It is a private decision and they shouldn't be telling someone what to do with their body even if they are not an Australian citizen. I wouldn't succumb to this sort of pressure if I were you.

  5. Yes. Your child will be born Australian if born on Australian soil because you (the parent) have permanent residency. Children born after the 20 August 1986 need to have at least one parent (which is listed on the birth certificate) holding Australian citizenship or permanent residency for the child to gain automatic Australian citizenship at the time of their birth.
