to cut a long story short, my boyfriend was acting like a drunk fool, and threw a brick at a friends car. he did some damage to her fender (FYI... he works at a car dealership) so he can get the parts and get the work done on the car. My friend still wants to claim the damage***** now, I have another friend who is an agent for "X" auto insurance, she said no one should claim! ADVICE.....?

  2. He shouldn't make a claim for the damage.  This could potentially raise his rates.

    Since your boyfriend is willing to fix the car for him, he should let him!

  3. your friend can claim the damage on her policy and be subject to a deductible she will not be able to file against your policy since this is not a car to car incident if she files to her policy she can say it was simple vandalism and it will be comprehensive claim or she can say who did the damage and her insurance will attempt to collect from your boyfriend.

  4. It depends on your bf and friend.  If your bf does good work and they have a good relationship, then I would let the bf fix the car.

    However, if they don't have a good relationship, then the friend should claim it on her insurance. If would be a comprehensive claim (for vandalism) and, in most cases, wouldn't affect her rate.

  6. Here's the deal: once the insurance pays to repair the friends car they can sue your drunken, idiot boyfriend for the entire amount.

    Perfectly legal and is exactly what I would do.

Your friend is smart to want to file a claim for the damage to her car.  These "off Insurance deals" often are nothing but trouble.  (parts don't fit, paint doesn't match, more damage found later, etc, etc.)   Your Boyfriend acted like a fool, now he should face the consequences.   Your other friend who is an agent gave bad advice (hmmm I wonder why ?)   Why even have insurance if you don't want to use it ?  The insurance companies must love people who keep paying them hefty premiums and then never have to pay out a dime because people don't want to use them  when an accident occurs.
