Auto accident: What is my case worth??

Question

I was hit by a big rig that ran a red light my car was totaled out which my insurance paid. Then I had to borrow money to buy another car so I could get to work and I had to go to 2 months of physical therapy for lower back pain the offered me $9,500 to settle and my attorney thinks its a great amount. However I still need to pay the attorney(33%) and med.bills ($2500) out of that amount so is that a good amount or am I just being greedy for thinking it is not enough?

I'd take ~4000 for putting up with some back pain.

I think its a pretty decent offer.  However if they just offered you that and thats their first offer I would try for more.  However I don't think you'll get much more but insurance companies usually have room to negotiate, they typically don't start at their maximum offer.  Of course they probably won't tell you what that is and its probably not like another $5000 if thats what you want.  They will have a limit they will go to to keep it out of court.  You might want to see if they will raise it another $1000, maybe they'll come back and say they'll meet you at $10,000.  Its not much more but it would be better than $9500.  Besides if you try and they say no then come back and say ok with the $9500.

That you had to borrow money to get a new car is not something

that the other party has to pay for. So what you are looking at

is basically 3135, to your lawyer and 2500 for your medical bills and

3835 for yourself. Doesn't sound like very much does it when your lawyer who was probably safe in his office when the accident happened gets almost as much as you do does it? If your lawyer thinks it is good amount I guess you are stuck with it. However if

this ever happens again I suggest you consider dealing with the

insurance adjuster yourself and eliminate the middle man.

Thats pretty good, you will make near 4000, i would be happy with that much
