Question:

Auto accident claim - what should I tell my insurance company?

I was on a small lane waiting for all traffic to clear before backing up into a parking spot.

There was a car signaling to turn onto the street I was on.

I waited for the driver to turn, but she did not move so I started reversing.

The driver of the other car, instead of turning, drove straight behind my car and I backed into it.

Her door had a dent, and my bumper was scratched.

We exchanged info but did not make a police report (did not know better).

There were no passengers or witnesses.

We also did not take any pictures of the accident.

I noticed that apart from the door, her car was not in good shape - it had several dents and the bumper was loose.

I tried to follow up with her, but did not hear back.

Only now, 2 months later, does my insurance company call and says that her company is making a claim, and that they need details.

How much I should say to my insurance company - are they on my side?

What would be the best course of action?

I'm at a loss right now....

Thanks!

  1. be honest they arent out to get you unless they find that you were less than honest than they will think your trying to hide something and your more guilty than you actually are

  2. Tell them the truth.  The adjuster will complete the liability investigation, determine your percentage of fault, and compromise a settlement with the other carrier.

Your insurance company is not out to get you.  If you fail to cooperate, they may have to pay 100% of the subrogation claim based on the information the other carrier has provided.

They may also cancel you for your failure to cooperate.

  3. I would tell it exactly as you have above..Your insurance will act on your behalf..They can only go by what you tell them. It is not a case of whos side the Insurance co is on...They are on the side of truth.. It may turn out that they will go 50 50 which means you can claim off each other..If there are no witnesses it is hard to prove either way who is to blame unless of course somebody admits liability. You will need to fill in a claim form and the Insurance co will take it from then.

  4. the truth you back into her would be the right answer and just what you said here.....

  5. Tell them the truth. What have you got to hide? Your insurance company is always on your side, that is what you pay them for.

Best course of action? Provide them with the information they are needing.

If you fail to provide a statement or withhold information ,this could be a breech in the conditions of your policy, resulting in a denial of the claim, and the other company going after YOU to pay them back
