my car was totalled. I have a medical condition of Fibromyalgia. I was diagnosed with Post Traumatic Fibromyalgia. The gentleman had Progressive Auto Insurance. They settled on my car a 2007 Honda Civic LX. They gave me $ 16,825.00 and $ 1,135.00 for Ohio sales tax. My neck and back hurt. What kind of settlement should I expect?????

  1. You need an attorney.........ASAP!

  2. Sue for a million for pain & suffering.

  3. I like his answer ^^^^^^^

  4. starrfyr... - typical insurance industry garbage. Reap in Million Dollar per day profits and refuse to pay out reasonable settlements to injured people.

Re Question: Unfortunately, the carrier will pay nothing for a diagnosis like Fibromyalgia. What were your actual injuries? If you were in a crash that caused that amount of property damage, did you suffer anything more serious than bruises, sprains and strains? Any broken bones? Any disc damage? Did you have any diagnostic tests such as MRIs or CT scans? What type of treatment did you receive? For how long? Did it help? How much are your medical bills for evaluations and testing and for treatment? Did you lose time from work? If so, what loss of earnings did you incur? This information is the minimum needed for your attorney (or any other knowledgeable person) to provide an estimate of the cases' settlement value.

  5. In most cases, unless your injury is of a permanent nature, like a broken bone or loss of use of a body part, temporary injuries such as whiplash or soft tissue injuries are not subject to insurance settlements. Too many people claimed whiplash and phony back injuries that insurance companies have tightened their restrictions on being able to collect for injuries.
