Question:

Automatic Renewal Clause in Lease?

Hello. I am writing because our lease just expired and I was informed that our lease automatically renews unless we send something in writing. Here is the exact terms of our lease:

"This lease shall begin on August 7, 2007 and end on July 31, 2008. This lease will be automatically renewed on a yearly basis unless thirty (30) days of written notice is given by either party of their intent to terminate this agreement, or unless another lease is signed by both parties."

To me that clause does not seem to be specific enough. I did not see a specfic timeframe in which we had to give the 30 days notice.

I have two questions:

1) Is this clause specific enough to legally bind us another year.

2) Are our landlords required to give us notice that our lease is about to be renewed??

I like in Oklahoma and have tried to find out our exact rights as tenants but it is hard to understand the legal documents available.

  1. 1.  Yes the clause is very specific.  You needed to give thirty days written notice prior to the expiration or it would renew.  Seems very clear to me.

    2.  The landlord did give you notice....it's call your lease.  Did you read it before you signed?

    No, the  landlord is not required to inform you that the lease is renewing, you were informed when you signed the lease.

    You sign for both.
