Automobile accident gone wrong!?

In case of a car accident...a minor collision with two cars...one car hit the rear of the car in front of it (obviously it was the car from behind who is at fault)...No damage on the cars...both cars left without taking any information down... What if the car who got hit from the back secretly took down the license plate number of the car behind...can the car that got hit at the rear possibly lie and call the cops after a couple of hours and claim that it was a hit and run? Or can the car that took down the plate number sue the other car for injuries even though there was no information taken down other than the plate number?

  1. anything could happen. deal with it if it does. I see all the time on safety that people think the driver that hits the back of another car is automatically at fault. this is not the case anymore and hasn't been for a long time. talk to your ins. carrier about it.


  2. A car cannot sue.  Only a human, a business, or the government can sue.

    But yes, a person who was in either car and claims that the driver of the other car caused the accident and claims to have been injured can use the license plate number to obtain additional information, including the name and address of the owner, and sue.

  3. The police would have to be contacted. They would investigate and find out what happened by talking to everyone involved.

    At any crash, it is the law to exchange Driver's Licence and Insurance information. If it was minor and you both agreed to drive away, I'm not sure what the police would do.

    Always inform police of any incident involving the slightest crash because if you were hit from behind, you could suffer injuries days or weeks after this slight crash.

    Once a car came up behind me and slid on ice. I saw him coming in my rear view mirror, moved ahead a bit, and he just "touched" my rear bumper. We agreed to "let it go"......the next day and for a week afterwards, my neck and shoulders were very stiff and sore. I didn't take down any of his information. I'm fortunate that it all just went away.

    A lawyer once told me that you should never "settle" with an Insurance company (who will hound you to settle by the way), for at least 6 months after a crash, especially if the other driver was at fault. You could suffer delayed injuries.

  4. The above answer is completely wrong and yes this has been done many times, that is why it is always best to get a police report for any type of accident for every ones protection but remember if caught lying you can be charged with filing a false report alone with other violations as well.

  5. No because both parties drove off. If the party that got hit had not drove off, then legal actions could be taken. After the scene of the accident is left, no further legal actions can be taken.
