My question is, say you're driving southbound on A Street, and Driver 2 is driving northbound on A Street. I am going Straight and Driver 2 going Northbound wants to turn left at the intersection (Theres not a turn light), say I keep going and Driver 2 turns in front of me and I crash into him. In the laws eyes, its Driver 2's fault for turning in front of traffic, HOWEVER in insurances eyes, YOU hit him so its your fault. So who's fault is it?

  1. The law is the same all over the world, you cannot turn in front of oncoming traffic, it is that simple.......


  2. you hit the side of his car which means he was well in the turn, you should have been able to slow down. right of way laws are not absolute

  3. Technically your fault, for hitting them.  What stopped you from slowing down and letting them turn?

    Though there are other factors to look at...

  4. Any vehicle turning across opposing traffic must wait until it is safe before making the turn...This means that the turning vehicle must yield to oncoming traffic (whether they are thru traffic or turning right)...Driver #2 could be cited by police for making an unsafe turn...I don't see where an insurance co. would find driver #1 at fault.

  5. it is his fault he turned in front of you ....he is the one to blame ur insurance company sounds like they just dont wanna pay ...threaten to sue them and watch them pay up very quickly ...even better tell them u will go to a newspaper and tell them about it....the out come will be the same but maybe faster...
