B/f is locked up ! help ..?

okay . we live in Indianapolis indiana & he just got locked up in the marion county juvenile center [or something like that] hes 17 years old . he was already on probabtion & had about 13 more days till he got off . then 3 days ago he was riding with his friend who got pulled over for having drugs . either that or his friend had drugs . today is his court day& the judge is either gonna let him go or keep him till septer 26 [his next court date]. does ne one know what shes going to choose ?? dont be negative please, just help me out .. dont tell me his a bad boyfriend just help if you can ..

  1. SInce he was on probation at the time of the incident, and then is caught breaking probation (being with someone who has an illegal substance) the judge will probably remand him to custody until his next court date.

    BF is the one who broke probation. No one else broke it for him. He needs to be responsible for his actions and learn from them. Next time he'll think twice before breaking probation.

In all honesty if he was that close to being done with probation he probably should have made better decisions and not be around more trouble.  Turn over a new leaf.  Since that's in the past hopefully he's learned a lesson there.  Don't you want a boyfriend that you don't have to worry about going to jail?  Find somone with a better head on their shoulders.

    As far as what the judge is going to say, you'll never know until it comes out of their mouth.  Sorry.  The judge could either add on to his sentence since he violated his probation or they could be lenient, which is doubtful.  You just never know.

  4. More than likely he will have his probation revoked. Held to next court date with a huge bond. And then given jail time for probation violation.  

    Doesnt matter he had 13 days left on probation. And being at least his second offense i highly doubt any judge will go easy on him.

    Depending on state laws and depending what his previous crime was, they may try to charge him as an adult.

    You might wana get a new BF for the next few months cause it looks like he will too...

Hmm, don't know that much about Indiana law, but in NY there are probably some similarities.  People in alternative sentencing programs like probation or drug treatment do tend to s***w up in the last leg (he was going to get his case dismissed when he was rearrested for homicide - it happens; in that case, judges are free to punish the defendant in any evet - a sort of "close but no cigar" approach.)

    That's what a criminal prosecution is about.  if the prosecutor decides that your friend didn't legally possess the drugs (or that despite the so-called "car presumption" that could be used to charge everybody in a car w/possessing a drug found inside but not on any one person, he decided NOT to go against your BF) then there is no case.  The judge in the new case will drop his charges and that would be end of that.  

    However, the judge overseeing the "Violation of Probation" will still have to decide whether or not to use that new case against him.  Likely, when your friend took the plea deal on the old case and got probation, he was told to stay out of trouble and not get rearrested - this means that your BF violated his probation even if he's not convicted, because an arrest requires a substantially lower level of proof than a conviction. This sounds unfair until you realize that by pleading guilty, your friend voluntarily accepted these conditions.

    What is the judge likely to do?  I'm going to take a stab and and say that I doubt this was your friend's first brush while on probation.  (Not to be mean, but many good probationers get their probation terminated well before the're left with 2 weeks.)  If it is, then the judge will feel more comfortable giving the guy a second chance.
