  1. Until 2005 what you have suggested would have been the case. However, in 2005 the 'Citizenship Act' was amended to prevent this very situation from occurring.

The current rule is that any child born after 1 January 2006 is a New Zealand citizen by birth only if at least one parent is a New Zealand citizen or entitled to reside in New Zealand indefinitely. Consequently, your child would not be allowed to claim residency or citizenship simply by having been born here and so you would not be able to claim either residency or citizenship either.

The link below will answer any questions you have regarding your status and that of your child, should he or she be born in New Zealand.

  2. I think you'd have to apply for residency. My parents had me while out in south africa and they applied for residency.

  3. no the law is the same as here, as its a british commonwealth you would still need apply for a visa to live in nz. i hear its quite easy though if you are british and skilled. visit the nz embassy website in the uk. regards terry

  4. No, sorry! :(

  5. No you would still need to apply for residency visa.

Coming from England will help especially if you have qualifications.

The law has been changed I think, so you may have to pay for your maternity care.

We had a lot of foreign mothers to be coming here to get free care, instead of paying for it at home.

Would suggest you contact the NZ embass over there as they will have all of the latest info, about the areas of expertise we are looking for in immigrants.

  6. I think that's a great idea - manipulate your baby's birth in order to settle on the other side of the world!  I should try that sometime too...

  7. No. If you were a permanent resident at the time, you could apply for your child to get it too, but if you are there on holiday you have absolutely no rights at all. And you really shouldn't be taking such a long flight if you are near to your due date. You will have great difficulty getting travel insurance after 32 weeks of pregnancy.

  8. Definite NO.  Only the baby has automatic rights to NZ citizenship therefore can have NZ Passport.  You will have to apply on your own merits.

There have been a few high profile cases of mothers being deported despite having a NZ born baby(ies).
