Back Disability and Pregnant?

I have a mess going on at work and I'm totally clueless as to what my rights are.

I have recently become pregnant and because of a pre-existing back problem my doctor has put me on a weight restriction of 10lbs. My job requires me to lift up to 70lbs so I went to HR about getting some of my responsibilities switched around (I work in a mailroom so there are plenty of other jobs I can do). HR basically came back to me and said that I can either temporarily cover an operator position or I can leave and go on FMLA. Apparently I can also utilize Short Term Income Protection but that is only if my doctor confirms that I can't work...and I CAN work! There is no need for me to leave work so soon!

Basically I think HR is not giving me very many options and it sounds like they are kicking me out without pay. Can someone explain to me what my rights are and what HR has to do for me? With a child on the way I can't take a medical leave without pay!

  1. If they've offered you a job (the operator position) they are in the clear . . . the law only requires them to make "reasonable efforts"  . . .  


  2. They gave you every option that are legally required to offer.  Take the operator job and hope your old job is still there when you get back.

  3. If your back was injured at work, you may be entitled to workers compensation benefits, specifically lost wages.

    If there is a temporary job that you can do, take it.  I looks like HR is trying to be helpful.

    Pregnant women often get back aches while pregnant.  They carry extra weight and the body gets deformed out of it's natural position.  Avoid anything that can cause or worsen back problems.

  4. What is wrong with the operator job?  They made you an offer, that's what they have to do.
