Question:

Backing up out of the driveway?

You don't see any cars coming as your backing your car out of the drive way. When you make it to the point were about 25% of your car is in the driveway and the other half is in the road. When another vehicle comes around the corner breaking the speed limit your way showing no signs of stopping. If you pulled out cause you were already in the process and they hit you. Who's fault with it be from the resulting crash?

  1. In the state of WA where I live, the vehicle on the road has the right of way over entering traffic. Entering traffic must yield. The law also states that if you can avoid an accident, it is negligence on your part if you do NOT. Either way, where I live, an accident under the situation you describe would be YOUR fault.

I believe that the car in the road would have the right of way.  The driver of the car in the driveway has the obligation to look for other cars and stop accordingly.  Now if it could be proven the car in the road was speeding, he could be cited for that and probably take some blame for the accident.  But I believe the bulk of the blame would be laid on the driver of the car pulling out of the driveway.

  4. iT IS YOUR FAULT BECAUSE YOU ARE BACKING INTO ON COMING TRAFFIC.  tHE IMPORTANT QUESTION HERE IS WHERE IS THE OTHER 25% OF YOUR CAR. yOU STATE THAT 25% IS IN THE DRIVEWAY AND THE OTHER HALF IS IN THE STREET.  WHERE IS THE REST??
