Bad employee and HR interferance?

I want to give a little overview for you so you can help me with the issue I am facing. I brought a person into my company who was a friend and needed a break. They did not have any experience in the field but I knew thew were smart and could pick up on the business. They were doing very good and progressing along nicely. My assistant got a new job in Calif and moved away about 5 month after this person started. The person I had brought into the business applied for the opening but because they were not experience or had no education required I explained to them that at this time they could not be promoted. The employee became upset and demanded that the deserved the promotion and I had better give it to them. I was going to terminate there employment but HR prevented me from doing so. The employees negative behavior began affecting other employees causing harm to the moral in the department. I again filed papers to terminate the employee and HR intervened to prevent it. HELP!

  1. Are you this person's supervisor?  While you can not be forced to hire someone without the necessary experience, neither can you fire someone for asking for a promotion.  HR is likely worried about company liability, and is working to protect the company, not you.  If you are not this employee's supervisor, then let it drop.  If they are disruptive and causing problems, they will be terminated, but the action needs to be initiated by the proper personnel.
