Bank error with a cashier's check?

I recently took a cashier's check out of my Bank of America account. The money was automatically deducted from my balance, until a few days ago when it mysteriously returned. I spoked with the person who cashed the check and they had no problems (cashier's checks are liquid anyways, it wouldn't really have mattered). My account shows that I never even took out the check.

No I've spent two days and countless frusterating hours on the phone with Bank of America customer service reps who have no idea what happened and can't seem to direct me to the right place. At this point, I'm ready to just give up and keep the money (almost 800$!). What do I do? Do I have any rights if I attempted multiple times to fix the issue and received no help? This is a cashier's check, so it's different than a regular withdrawel or check.

Another interesting point is that the check states on the front that it MUST be negotiated within 90 days. Does this apply to the bank as well?

  1. I would put the $800 into your savings account.  The bank will find it eventually.  That way you have the money to cover check.  Unless it has been over 18 months I'd still just hold on to the money, after 18 months, they likely will never find the error.
