Bankruptcy- credit card usage prior to filing question?

What usually happens when you haven't paid a couple of your credit card companies for a few months and have one c.c. left that you can charge on, so you do and then don't pay it either and then in a couple of months file for bankruptcy? Does this REALLY make it more difficult to file Chapter 7?

  1. You typically will have to provide receipts for purchases made over $600 within the 90 days before filing. If you have to use a credit card to buy groceries or something really important before you file, it won't be too big of a deal. Now, if you go out and buy yourself a big screen T.V. right before filing on a credit card, expect to pay that back. The creditor will likely file something with the Court stating you racked up however much you spent 90 days before filing, and then you will still be held responsible for it. I typically see Best Buy fight recent charges.


  2. As long as it's been a gap of about 2 or 3 months between the last use of the credit card and the filing for bankruptcy you should be perfectly fine.  Just DON'T use any cards again if you are going to file - as tempting as it might be, don't do it!!!!!!

    Just filed and have been accepted myself - unlike so many people who say "so much stress off your shoulders" I say "so much more stress on your shoulders" as I am now scared I will loose loved family members and friends who wont understand...

  3. No, not really.  Though, you may be questioned by the judge when you go to court about this situation...but really, they love putting BKs on a credit report!  They just love to destroy ppls credit!  Hmm...that sucks!
