  1. Seek the counsel of a good bankruptcy attorney in your area, most will see you on a free consultation. Though a spouse can file alone, the courts do look at the household income. If you have a home together and planning to keep it, you can re-affirm, based on what you qualify for. Your attorney would be the one to tell you what you qualify for, and it's all based on median household income. The attorney will look at income for the past 6 months (check stubs), assets, list of all the debts and last 4 years of taxes, this will tell them what you qualify for. You can review this website....www.bcsalliance.com or www.totalbankruptcy.com to give yourself a little more info on bankruptcy and how it works and effects you. Good Luck!!
