Bankruptcy question, How long after filing bankruptcy am I no longer obligated to make payments?

Me and my husband are wanting to file bankruptcy. He is in the military and we have a lot of "allotments" (where money comes out of his paycheck automatically before we see it to creditors) How long will it take after we file bankruptcy until we are no longer obligated to make payments to these creditors or when can we stop the allotments? Does it happen as soon as you file or what?

Also, Does filing bankruptcy effect you being able to rent a house/apartment?

Thanks!

  1. You will need to ask your bankruptcy attorney when to stop these payments and how to go about doing so as you don't want this to effect the filing..they will advice what to do about the creditors once they know who they are. When you file and pay the attorney, they should get you a case#....once you get the case # the courts will notify the creditors, usually takes about 30 days...if creditors call you, you tell them you filed and they cannot legally contact you again as you are protected under the bankruptcy laws...As far as the automatic payments, talk to your attorney, they may just need the creditor information and once you get the case# they can fax to have it stopped immediately..but...your attorney is the one you need to be asking....Bankruptcy can effect the renting of a house or apartment as the bankruptcy stays on your credit report for 10 years. It will depend on if the place you are renting checks credit reports. Good Luck!

  2. It's best if you talk to a Bankruptcy attorney.
