Becoming a legal guardian in new york?

Can someone become a child's legal guardian if both birth parents are still alive? Is it true that the only way for this to happen is if one parent dies or is labeled "unfit" and is stripped from their guardianship? Is there any other way?

  1. The other way is to have the parents voluntarily sign over custody. You should be able to find these paper though the family court.  Go to the link below, it's for NYC family court system. The first link is to the custody page and the second i for the guardianship page.
