I have some 5 year old unpaid debt 12k credit card . why would it take them so long to come after me? 3 years ago they sent me a summons for a court date which I turned over to my attorney! havent had to show up in court yet! the statute of limitations is 6 years in ct

  1. If you were issued a summons most likely you already have a judgement against you. In that case the statute of limitations becomes longer (check you state on SOL for judgements). When you don't show up to court when issued a summons the plaintiff typically wins by default. COnsider a debt settlement program before having a lien placed on your home or wage garnishment. You would probably not be able to refinance your home nor get many other types of credit without paying the judgement.

    The legal system is painstaking slow so it is not impossible that it would take two years for the court case to progress through the court system.  

    What I am more shocked about is that YOU decided to wait for the credit card company to come after you instead of trying to set up a payment arrangement with them to avoid court altogether -- not to mention the escalating costs of an attorney.

    You should be happy that they took 5 years to come after you.  That means you have had 60 months to come up with a creative way of paying the amount owed.

    Their lateness should have worked in your favor.

  4. Your attorney might have been able to stop the suit through procedural maneuvering. Call your old attorney and ask him what happened before you do anything else.
