  1. Not necessarily. The rules are that the job becomes redundant, the person doing that job is obviously the most likely to be let go.

    The firm should first have sought every opportunity to place the redundant employee into another position, even exploring the possibility of retraining.

    The firm should also assess, (fairly) the particular skill sets of employees, to gauge which are more appropriate to fulfil the companies needs.

    The firm should also have consulted their workforce as to who might wish to take voluntary redundancy, early retirement, shorter working hours, shared work roles, flexible working hours or even a leave of absence.

    Once these steps have been seen to have been taken , the firm can effectively release whomsoever they wish.


  2. Depends on any agreements with your union and the company you work for.

    They could ask for volunteers first.

    Then any temp staff will be next to go.

    If you have no union or no agreements then the company can pick and choose who goes...who stays.

  3. The employer must follow a set procedure to make you redundant. The law says that, the employer should try to find you alternative employment, should use objective criteria when deciding who will be made redundant, should try to give as much warning of the redundancies as possible and should try to ensure that the selection for redundancy is fair and in accordance with the criteria he or she has set.
