My father has a bench warrant that was issued to him in another county in the upper peninsula, he now lives with me in the lower peninsula. If he were to turn himself in and the issuing county doesn't come retrieve him will the bench warrant be dropped.

  1. Whenever anyone has a warrant bench, they must go to the court that issued the bench warrant and deal with the issue, whether it is a fine, failure to comply with probation or jail.  Once the case is called in the court, the warrant is "recalled and quashed."

Unless or until your father goes to the other court, meaning walking into the court with his own 2 feet, he risks being arrested and transferred to the county where the warrant was issued.  This process takes some time and your Dad will remain in custody.  It is best for him to do this voluntarily and not with the assistance of law enforcement.

  2. Usually if there are warrants from the same state it would be extraditable.  If he is ever caught rolling a stop sign, running a red light, etc, they will run his name, dob, social, and driver's license number and bingo the warrant will appear.  Only the judge can drop the warrant, not the police.
