Question:

Best way to proceed with my husband adopting my son?

The birth father is not listed on my son's birth certificate, nor has he paid child support of any kind. Not only that, he opted out of his parental obligations, long before my son was born. (From which many blessings have derived, trust me.)

I am married to the only man that he's known as his father. He calls him Daddy, and loves him very much. That said, I'd like to make sure that both my husband and son are "legally" protected, should something happen to me.

Any suggestions for the best way to approach the adoption process in the most cost effective way?

  1. above all, please tell your son the truth about his bio father.  at least that it is a different person.  he will find out one day, and will be devistated if you don't tell him the truth at a young age.

    If you were unmarried at the time of conception and birth and did not list a father on the birth certificate all you have to do is file a amended birth certificate with the Office of Vital Statistics.  Take your new BC to the Social Security office and get a new ss card,

  3. My husband is trying to adopt my sons. I am in a slightly different situation as their dad was married to me at the time of their birth.

    1. you must contact social services in writing a minimum of 3 months before you apply to the court stating your name, address, childs name and date of birth and the name of the person wishing to adopt. (Informing of intention to adopt)

    2. social services will come for a meeting and must do a police check on the person wishing to adopt. they explain the procedure in full

    3. you contact the civil court and obtain application form.

    4. social services will interview child (dependant on their age) and ask how they feel about being adopted and what their relationship is like with the person wishing to adopt.

    5. If the father is listed on birth certificate then he must be contacted to give his permission if not then it application goes into the court.

    6. a court date is issued and either adoption is granted or refused.

  4. Get a famliy lawyer and have the paperwork started.  Since the birth father hasn't made any contact and hasn't paid any support he will most likely be found guilty of abandonment so that would take away his rights then your husband could adopt your son with no problems.  A lawyer will have all the paperwork that needs filed and can make sure it is all done legal and for sure.
