Bill collectors......?

are bill collectors able to have your check garnished even after stating that I am willing to pay but only through the mail and with a Money order...yet they only want it through a banking account.

I am just guessing that they are trying to intimidate me into paying, yet I keep telling them I don't have a bank account.

Also, I would like to know the procedure a bill collector company would have to go through in order to get my check garnished if anyone knows.

  1. I believe they need a court judgment first. If you can pay your bill at the store instead of mailing it would be a good idea. Just walk into the store and pay on your account.


  2. If you signed a deal with them to garnish your wage they can other wise they have to take you to court. They want to avoid this due to the approximatley 300 in courts cost. Only after a court hears the case can the judge assign a garnish ment. but if you are attempting to work with them then they ussually side with the defendant. If you want to establish athat you are working with them pay some body to write a check on your behalf when that check is deposited it does provide a history of payment  do this once amonth and you are good

    If you signed an ACH agreement they can attempt to hit your bank account on your payday

    If you have said you are wiiling to work with them they should want to work this out as it will behoove them, ask to speak to a supervisor as usually the caller is just a 9.00 an hour worker an has no real power but accept a preset amount.

  3. Garnishment is not an easy or a cheap task for those collecting from you.

    First they have to get a Judge's permission so the amount owed has to be considerable $2000 is probably a starting point , after the judge has put a motion towards garnishment , you will be informed by mail,you can write the judge  to contest the garnishment ,you can put forth that you have made attempts , or are unable to pay as required if the judge agrees with you the garnishment never happens.

    If the garnishment does go through your employer gets a letter, a court document that you are to be garnished a percentage of your check and where it's to be sent , you employer must comply or be subject to a court appearance
