Bill - not paying because of technicality?

Here's the deal -

My brother "John Johnson", and his girlfriend "Sara Smith" had to take their son to the hospital (he fractured his finger). The girlfriend filled out all of the paper work. She put her name as the mother, put her sons name down in all the right spots too.

Then the bill came and the name on the bill is "Sara Johnson" (her first name, his last name). This wasn't a mistake she made, it's a mistake the hospital made. So now she figures, she doesn't have to pay because of the technicality.

any truth to that?

  1. She sure is a great role model for her child. She owes the money no matter what. Her excuse will not fly. She can apply for assistance if she really needs it.


  2. She is obligated to pay for the services she received . The typo alone should be partial proof in itself legally and morally she has no other course then to pay what she owes. I'm sure the testimony of the doctors who treated her should show the typo for what it is.

  3. That is unreasonable and the law fills in the terms that are not reasonable.  I would be concerned about a fraud in naming a person as a dependent for purposes of the insurance claim.  If you do not want to pay, I would wait to see what happens with the insurance company of the girlfriend.    

  4. Sounds like a simple typo and do u really think a creditor is going for that, ha she'd do better saying she never got the bill.
