Biological fathers surname over husbands?

My girlfriend and I are having a baby in two months. She is married but has been seperated for nearly two years now. Our question is, in Louisiana, how much trouble will it be to give the child my last name and not hers or her husbands? She wants this as much as I do.

We have been considering legally changing her last name before birth, but that could be construed as fraudelant and two months isn't a whole lot of time to do that. We'd rather handle this at the hospital if possible.

  1. She can legally change her name to whatever she wants, as long as she never says she's divorced.

    She can also name the baby whatever she wants. If your name is on the birth certificate, which, you being the father I presume you will be, there will be no issue with your surname being the babies.


  2. There's a line on the birth certificate for the father's name and signature. The mother's name is used only when the father is not named or he has signed off of the baby.

  3. The mother can name her child ANYTHING she wants to!!  At the hospital, no questions are asked in regards to whom the child is named after or whose name the child will be receiving.

  5. You may call the hospital and talk to someone from the postpartum area.

    I know that in Nebraska a mom can give her baby anyones last name she wants to. However, there is a spot on the birth cert form that asks if she is married. In Nebraska it doesn't matter if her husband is baby's daddy or not, he gets listed as the father becasue he is married to her.

    But someone at the hospital should be able to help with your questions, and you can probably get them answered without revealing your name right now.
