  4. Both are illegal and at risk for deportation. Neither criminal is preferred over the other.

The laws certainly tend to treat entry without inspection ("border hopper") as a more severe violation.  But I think the difference in the two civil violations are in name only.  That is, the intent is usually the same and people want to stay in the United States because of better opportunities, maintain family ties, etc.  However, people that got visas are usually the ones that had time to wait and/or money to spend.  In other cases, some foreign nationals simply do not qualify for a visa that they could obtain anytime soon.
