Boss disclosing medical information?

Ok so i was diagnosed with severe depression and my boss tells my coworkers about this after i told him not to then i start receiving derogatory comments from him and coworkers, i tried to ignore it but couldn't any longer, i went to my bosses boss and told him the situation and all he tells me is that rumors happen and there is nothing he can do about it. i don't even feel comfortable going to work anymore, is there any legal ramifications for there actions? any help is much appreciated, thank you

  1. He can't do that. Do you have a union-if so find your steward. Do you have an association that can be your advocate? Never mind the comments. People who talk in such a way are generally ignorant and not worth your time.

    Never tell your boss anything personal unless it has to be disclosed. Also if anybody makes another comment regarding your neurotransmitter  imbalance just ignore them. If I had that problem I would tell them I have a contagious depression.

    Don't go after him-just leave it. Your managers sound like dinks.


  2. It is right that your doctor is bound by HIPAA to not release medical information.  Your boss is not regulated by that law. If it is truthful that you are being treated for depression, it is not slander.  I don't know if it would come under "hostile work environment" or not.

    Sadly, we have laws for almost everything.  I'd like to see being charged as a criminal jerk for some people. We need to talk to legislators on this.

    I really hope that your treatment is helping you.  It really is hard, and idiots like this, don't make it easier.  Empowerment may be a good concept for you..write a letter, explaining just what a low life he is.  

  3. your doctor is not even allowed to discuss your medical condition with anyone without your expressed permission. file a formal complaint with the company regarding your boss, and his boss for blowing you off and contact the labor board in your state. (and find a new job)

  5. You need to get proof. If he really is disclosing your private info, you can sue him!
