Boss overpaid me for 45hrs, do i have to pay it back?

So for the last 2-3 mo starting back in june i've been overpaid for a total

of 45hrs. Now for most of june, july and august we were not receiving our pay stubs and so i didn't notice. I thought i earned what was in my pay. Is it illegal not to receive pay stubs?

Well Weds my boss noticed that she was paying me for a day that i did not work anymore, but the thing is she has to enter our hrs by hand each week so i don't know how she did not notice. So she now wants me to either pay back the money, work an extra hr or two for free, or have it deducted out of my pay each week. I cannot afford this. I had no idea that i was even getting paid xtra. And for her not to notice for 2-3 mo its not my fault. I do not think i should have to pay for her

mistake. On top of which now the taxes and everything is messed up. Is there anything i can do. i refused to agree to anything until i talk i know what my rights are.

And to be honest she was going thru it today and there was even a day on there that she didnt even pay me for. So obviously she makes errors. Again not my fault. Get a freakin time clock and not hand written time slips. She also does all payroll thru quickbooks.

  1. Yes, you will be responsible for repaying an error, and they can take it right out of a paycheck without asking leaving you totally broke.

    Always keep track of your own hours so when things go wrong like that you have proof...for example, she's much more likely to catch a mistake that COSTS her money than to find the mistake that rips you off...know what I mean?

    If she's making errors that makes it even more important, even make photocopies of the schedule, tell her you're doing it to make sure you don't miss work or something.......

  3. Even though it was her mistake you owe her. Keep record of all schedules and pay given. IRS is not far away.

    I would ask her to take it a little at a time because you could not afford it. Or, work and extra hour each shift to make it up. Be fair to her and she will be fair to you.
