Bought a Batman limited edition action frame on eBay to replace a broken one and this one doesn't work either!

I asked the seller countless times if it worked. He said it did. Now I get it in the mail today and it doesn't work. It's supposed to have Batman, the Joker and Harley Quinn come out from different angles and have an action scene. But NOTHING - It doesn't work. I called the seller and mentioned their return policy which states "Item must be returned within: 7 Days - Refund will be given as: Money Back

Return policy details: Seven Day Money Back Guarntee; MINUS SHIPPING AND HANDLING"

Now the woman on the phone tells me that the owner goes Case by Case, and that he doesn't abide by that rule they show on their eBay listing. IS THIS ILLEGAL??? They say they aren't giving me any money back because it worked when it left, but the packaging was HORRIBLE! What should I do???

If it says money back guarantee then he has to obey by the rules. I would call ebay and tell them what happen.
