Bought a camcorder at Ebay -- doesn't work -- help!!?

Ok, I know I should not have done this... But I had this same type of camcorder for 3 years with no problems. I liked it SO much (and it's not available in stores anymore) I decided to look on ebay.

Found the camera, the description said the camcorder was "only used once" for a school project and was 'like new'.

I bought it, and it looked ok, but then the tape deck wouldn't open. When I finanlly DID get it open, it wouldn't read any of my tapes or film ANYTHING!!!

The seller never stated ANY problems. They said it was used once... BUT, in the auction they say "No Refund, All Sales Final"....

I filed a paypal complaint, but could I get screwed in the end because they said "no refund, all sales are final" even though they sent me a camera that clearly doesn''t work?

How should I handle this?

  1. Even if the seller says "No refunds, all sales are final" they are still responsible for getting you the item in the condition stated.  

    When you escalate your dispute to a claim, you will probably need to ship the camera back to the seller, well-packed, using a trackable shipping method.


  2. I'm hoping you'll get your money back. They'll still keep the shipping, but according to Paypal's rules for a valid transaction, you must receive the item in a condition "exactly as described". To me, the "no return/refund" policy only applies to an item you got which was as advertised. If they would have stated it was damaged, you would be stuck. But since they claimed it was in such pristine condition, and it wasn't, you should be entitled to your money back.
