Bought a house in PA, I want to break my apartment lease?

Hello, I bought a house in PA, Montgomery County. I currently rent an apartment. I spoke to my leasing office about 3 months ago, they said I was going to have to pay a fee of $300, give a 30 day notice, and I wouldn't have to pay any penalties. Now they are saying that I am breaking my lease without sufficient notice, and that I have to pay a 3 month penalty? is this true? how can I avoid this?

Is there any laws regarding breaking a lease because of buying a house?

  1. There is no "get out of lease free" card due to the purchase of a house.

    Your lease is a binding contract and you are expected to fulfill the lease terms.

    What was said 3 months ago is worthless, unless it was in writing.

    If they require a 3 month penalty pay it.

    Legally, you could be held liable for the rent until either the lease expires or a replacement tenant us found, as well as advertising costs, agent fees and any re-letting/adminusrative fees per your lease.

    You can be sued for the above mentioned costs, get a judgment ordered against you (all monies owed + court costs & interest), have bank accounts or wages garnished or have a lien placed against your new home.


  2. Have you looked at your lease agreement? The answer is in there. It's what you agreed to when you moved in.  The answer is most likely, "no it doesn't matter whether you bought a residence or not".
